Welcome to webdesign-kashmir.com. These Terms of Service ("Terms") govern your use of our website and the web design, development, SEO, and digital marketing services provided by Web Design Kashmir ("we," "us," or "our"), owned and operated by Muzamil Ahad. By using our website or engaging our services, you agree to these Terms.

1. Services

Web Design Kashmir provides web design, web development, e-commerce development, search engine optimization (SEO), mobile app development, digital marketing, UI/UX design, website maintenance, and related digital services. Specific deliverables, timelines, and pricing for each project are outlined in individual proposals or quotations provided before work begins.

2. Quotations & Pricing

All quotations are valid for 30 days from the date of issue unless otherwise stated. Prices published on our website and in proposals are in Indian Rupees (₹) unless otherwise specified. Domain registration, hosting, third-party tool licenses, and stock images are not included in website design pricing unless explicitly stated. We reserve the right to update published pricing, but any agreed-upon project price is locked once the proposal is accepted.

3. Payment Terms

  • Starter packages: 100% payment before work begins.
  • Professional packages: 50% upfront, 50% upon completion before launch.
  • Enterprise packages: 50% upfront, 50% upon completion before launch.
  • Monthly services (SEO, maintenance): Invoiced at the beginning of each month. Payment due within 7 days.

Accepted payment methods include bank transfer (NEFT/IMPS/UPI), Google Pay, PhonePe, Paytm, and PayPal (for international clients). Late payments beyond 15 days may result in project work being paused.

4. Project Process

Every project follows our standard process: Discovery → Proposal → Design → Development → Testing → Launch → Support. Changes to project scope after the proposal is accepted may affect the timeline and cost. We will notify you in writing of any scope changes and provide a revised estimate before additional work begins.

5. Client Responsibilities

You agree to provide all necessary content (text, images, logos, credentials) in a timely manner. Delays in providing requested materials may delay the project timeline. You are responsible for providing accurate business information, reviewing and approving designs and content within 5 business days, and providing hosting and domain access when required.

6. Revisions

The number of design revisions included depends on your package: Starter includes 1 round, Professional includes 3 rounds, Enterprise includes unlimited rounds. A "round" is a set of feedback provided at one time. Additional revisions beyond the included rounds are charged at ₹2,000 per round.

7. Intellectual Property

Upon full and final payment, you own the website design, custom code, and all deliverables created specifically for your project. We retain the right to use the completed work in our portfolio and marketing materials unless you request otherwise in writing. Third-party assets (licensed fonts, stock photos, premium plugins) remain under their respective licenses.

8. Refund Policy

Our comprehensive refund terms have been updated to reflect strict, transparent guidelines. Due to the rapid allocation of resources, we do not offer refunds once a project deal is finalized and any work has commenced. 9. Website Support

Free post-launch support is included as part of your package (1 to 12 months depending on the plan). Support covers bug fixes, minor content updates, and technical assistance. Major feature additions, redesigns, or structural changes are treated as new projects and quoted separately.

10. Limitation of Liability

We are not liable for any loss of revenue, data, or business opportunities arising from the use of your website. We do not guarantee specific search engine rankings, traffic volumes, or revenue outcomes. Our total liability for any claim related to our services is limited to the amount you paid for those services.

11. Confidentiality

We treat all client information as confidential. We will not share your business data, login credentials, customer information, or proprietary content with any third party without your explicit consent, except as required by law.

12. Website Hosting & Domains

We help you set up and configure hosting and domains, but the hosting account and domain are registered in your name and owned by you. We do not hold domains or hosting accounts hostage. Your data belongs to you at all times.

13. Termination

Either party may terminate a project by providing written notice. If you terminate, payment terms in Section 8 (Refund Policy) apply. If we terminate due to circumstances beyond our control, we will refund any payment for undelivered work.

14. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms or our services shall be subject to the jurisdiction of the courts in Srinagar, Jammu & Kashmir.
